These Terms and Conditions (“Agreement”) govern your use of Kamila Muffin Shop (https://kamilamuffinshop.co.uk) (“Website”) and your purchase of any products or services offered on the Website. By accessing or using the Website and making a purchase, you agree to be bound by this Agreement.

1. Intellectual Property

All content, including photographs, images, text, graphics, and logos, displayed on the Website are the intellectual property of Kamila Magdalena Notario-Galaj (“Owner”) and are protected by copyright laws. You may not use, reproduce, distribute, or modify any content without the Photographer’s prior written consent.

2. Orders and Payments

2.1 Product Information

The Owner strives to provide accurate and up-to-date information about products on the Website. However, the Owner does not warrant that the product descriptions, images, or other content on the Website are error-free, complete, or current.

2.2 Pricing

Prices for products and services are displayed on the Website and are subject to change without notice. The final price will be confirmed at the time of purchase. All prices are in British Pounds (£) and do not include applicable taxes or shipping fees unless explicitly stated.

2.3 Order Acceptance

Your order constitutes an offer to purchase a product or service. The Owner reserves the right to accept or decline your order for any reason, including product unavailability, errors in pricing or product information, or suspected fraudulent activity.

2.4 Payment

Payment for products or services must be made in full at the time of purchase unless otherwise agreed upon in writing. Payment methods accepted are debit card and PayPal.

3. Shipping and Delivery

We offer various shipping options for the delivery of physical products. During the checkout process, you will have the opportunity to select your preferred shipping method. The applicable shipping fees will be displayed at checkout and may vary based on the destination, weight, and size of the product.

3.2 Shipping Timelines

We make every effort to ensure that products are shipped promptly. However, please note that the estimated delivery times provided are estimates only and are not guaranteed. Factors such as carrier delays, customs clearance, and unforeseen circumstances may affect the actual delivery date.

3.3 Shipping Address

It is your responsibility to provide an accurate and complete shipping address at the time of purchase. We will not be liable for any delays or non-delivery resulting from an incorrect or incomplete shipping address provided by you.

3.4 Shipment Confirmation and Tracking

Once your order has been shipped, we will send you a shipment confirmation email that includes the tracking details, if available. You can use the tracking information to monitor the progress of your delivery.

3.5 Delivery Attempts and Signature Requirements

For certain shipments, a signature may be required upon delivery. If you are not available to receive the package, the carrier may attempt delivery on subsequent days or leave a notification for you to arrange pick-up or reschedule delivery as per their policies. It is your responsibility to ensure someone is available to receive the package or make alternative arrangements with the carrier.

3.6 Shipping Damages or Loss

In the event that your package arrives damaged, please notify us immediately. We may require photographic evidence of the damaged package and its contents. We will work with you to resolve the issue and, if necessary, initiate a claim with the shipping carrier. Please note that any claims for shipping damages or loss must be reported to us within 14 days of receipt.

3.7 International Shipping

For international shipments, please be aware that customs fees, import duties, taxes, and other charges may apply. These additional charges are the responsibility of the recipient and are not included in the product or shipping costs. Please check with your country’s customs office for information on potential additional fees before placing your order.

3.8 Digital Products and Services

Digital products or services will be delivered electronically to the email address provided by you at the time of purchase. You are responsible for ensuring that the email address provided is accurate and accessible.

Returns and Refunds

RETURNS

You have 14 days from the date of your purchase’s delivery to initiate a return or exchange. To begin a return, please contact us at hello@kamilamuffinshop.co.uk, and we will provide you with a return address. Please note that return shipping costs are currently the responsibility of the customer, so kindly arrange and cover the shipment for the return. For added peace of mind, we recommend using a tracked service when returning items.

When returning your package, please be sure to clearly mark it with your full name and order number. The item being returned should be in the same condition as when you received it, free from any damages. Once we receive the returned package, we will promptly process your refund.

Please be aware that personalised orders are non-refundable and cannot be exchanged.

EXCHANGES

If you want to exchange an item, please follow the same process outlined above for returns. After completing the return, you can then proceed to place a new order for the item you require.

CANCELLATIONS

Please note that all our prints and clothing items are made to order. As a result, once an order is placed, the information is immediately sent and processed by our printing team. If you wish to cancel an order, please contact us at hello@kamilamuffinshop.co.uk, and we will make every effort to cancel it before the printing process begins. If the order has already progressed too far in the production process, we will guide you through the return process mentioned above.

Damaged or Defective Items

If you receive a damaged or defective physical product, please contact us at contact@kamilamuffinstudio.com within 14 days of receipt. We will assess the situation and, if applicable, provide a replacement or offer a refund at our discretion.

Digital Products

All sales of digital products, including photographs and digital artwork, are final. No refunds or exchanges will be provided for digital products.

Non-Returnable Items

The following items are non-returnable:

  • Digital downloads
  • Custom-made or personalised products

Limitation of Liability

To the fullest extent permitted by law, the Owner shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Website or the purchase of products or services, including but not limited to loss of profits, data, or business opportunities.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom of Great Britain and Northern Ireland. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of United Kingdom of Great Britain and Northern Ireland.

Modifications to the Agreement

The Owner reserves the right to update or modify this Agreement at any time without prior notice. The updated Agreement will be posted on the Website with a revised “Effective Date.” It is your responsibility to review this Agreement periodically for any changes.
